James E. Mitchell, Jr.

Jimmy is a founding member of Berryhill & Mitchell, PC. He has been representing and counseling businesses and individuals in Alabama since 2003 and he has been trying jury and non-jury trials since he started practicing over twenty years ago. Throughout his career, Jimmy’s practice has involved multiple areas of the law including workers’ compensation, personal injury, construction, appellate advocacy, premises liability, dram shop, contract law, products liability, wrongful death, and employment law. His experience, including the first six years in which he represented plaintiffs in civil litigation, gives him a unique ability to evaluate a case, early on, from the plaintiff’s and defendant’s point of view.

Jimmy’s practice at Berryhill & Mitchell focuses primarily on defending and counseling businesses in workers’ compensation, construction, and general insurance defense matters. Jimmy also heads the firm’s appellate advocacy practice and, as part of that practice, has been called upon to write Amici Briefs for various businesses and trade organizations. Jimmy also speaks and presents for small and large businesses, employers, insurers, self-insurer funds, third party claims administrators, claims professionals and other industry groups on various topics including workers compensation claims, the utilization review process in Alabama, Workers’ Compensation Medicare Set-Aside Arrangements (WCMSA) and Alabama construction law.

Jimmy has always had a passion for technology. He ensures that the attorneys and staff at Berryhill & Mitchell are technologically savvy, not only with office technology, but with mobile devices and applications, as well as courtroom technology, so that Berryhill & Mitchell can most effectively and efficiently communicate with and represent its clients. Jimmy, combining his knowledge of Alabama’s Workers’ Compensation Act with his passion for computers and technology, created the algorithms and calculations for Berryhill & Mitchell’s workers’ comp calculators.

Jimmy was born and raised in Abingdon, Virginia.  Jimmy and his wife Aarin, a first grade public school teacher who he met at the University of Kentucky, are the proud parents of two daughters.  The Mitchells are avid Kentucky Wildcat fans.

Jimmy is a founding member of Berryhill & Mitchell, PC. He has been representing and counseling businesses and individuals in Alabama since 2003. With over two decades of litigation experience, he has tried many jury and non-jury trials across a wide range of legal matters. His practice has spanned multiple areas ,including workers’ compensation, personal injury, construction law, premises liability, dram shop liability, contract law, products liability, wrongful death, employment law, and appellate advocacy. His early years representing plaintiffs in civil litigation provide him with a comprehensive perspective, enabling him to assess cases strategically from both the plaintiff’s and defendant’s standpoint.

At Berryhill & Mitchell, PC, Jimmy primarily focuses on defending and advising businesses in workers’ compensation, construction, and general insurance defense matters. He also leads the firm’s appellate advocacy practice. Jimmy is also a trusted speaker, presenting on workers’ compensation claims handling, Alabama’s utilization review process, Workers’ Compensation Medicare Set-Aside Arrangements (WCMSA), and construction law for businesses, insurers, self-insured funds, third-party administrators, and industry professionals.

A technology enthusiast, Jimmy ensures that Berryhill & Mitchell stays ahead of the curve in legal tech, integrating cutting-edge tools into both office and courtroom practice. He has personally developed custom algorithms for the firm’s workers’ compensation calculators, which will soon be available on the firm’s website to assist claimants, attorneys, claims professionals, and businesses in evaluating workers' compensation cases more efficiently. By merging his legal knowledge with technological innovation, Jimmy is making these tools accessible to support more informed decision-making across the industry.
